NOTICE PURSUANT TO ARTICLES 13-14 OF THE GDPR (GENERAL DATA PROTECTION REGULATION) 2016/679
We inform you that, for the establishment and execution of contractual relationships, our organization may acquire your data, also verbally, directly or through third parties, which are classified as personal by Regulation (EU) 2016/679 (GDPR) and Legislative Decree 196/2003 as amended by Legislative Decree 101/2018.
According to the aforementioned regulation, this processing will be based on principles of fairness, lawfulness, transparency, and the protection of your privacy and rights.
Nature of the data processed: we process your identification, tax, contact, and financial data necessary for the execution of current or future contractual relationships, provided by you at the time of conclusion and execution of contracts or during pre-contractual negotiations. We do not possess any data classified as special or judicial (Art. 9 and 10 of the GDPR).
The Controller’s services are not intended for individuals under the age of 18, and the Controller does not intentionally collect personal information regarding minors. If the person providing the data is a minor, such processing is lawful only to the extent that consent is given or authorized by the holder of parental responsibility, whose identifying information and copies of identification documents must be acquired. Otherwise, if information about minors is inadvertently collected, the Controller will promptly delete it.
Purpose of the processing, duration, and legal basis: your data will be processed throughout the contractual relationship and thereafter, without your explicit consent under Art. 6 letters b and f GDPR, exclusively for the following purposes: to fulfill pre-contractual, contractual, and tax obligations; to comply with legal obligations, regulations, community legislation, or orders from authorities; to exercise the Controller’s rights, such as the right to legal defense. The Controller will retain personal data for as long as necessary to fulfill the above purposes and, in any case, no longer than 10 years after the end of the relationship.
If you are already a customer, we may send you commercial communications about services and products similar to those you have already used, unless you object (Art. 130 Legislative Decree 196/2003 and Art. 21 para. 2 GDPR).
In the case of processing requiring your consent as a legal basis, we will obtain it in full compliance with applicable regulations.
Requirement or option to provide data: regarding data we are obliged to know to comply with legal obligations, failure to provide such data will make it impossible to establish or continue the relationship, within the limits in which such data are necessary for its execution.
Scope of knowledge of your data: the following categories of individuals may become aware of your data as processors or authorized subjects appointed by the Controller: executives, directors, auditors; internal secretarial staff; accounting and billing staff; service marketing staff; third parties (e.g., website management and maintenance providers, suppliers, banks, professional firms, etc.) acting as external processors on behalf of the Controller; Supervisory Bodies, judicial authorities, and all other parties to whom communication is mandatory by law to fulfill the purposes indicated.
Communication and dissemination: your data will not be disclosed to unspecified parties by making them available or subject to consultation. Your data may be communicated, within their respective and specific competence, to public entities or private parties where there is a legal obligation or necessity of communication, as well as to our consultants, within the limits necessary for their tasks and under a confidentiality and security agreement.
Your rights: as the data subject, you have the rights under Art. 15 GDPR, namely the rights to: i. obtain confirmation of the existence or not of personal data concerning you, even if not yet recorded, and their communication in an intelligible form; ii. obtain information about: a) the origin of personal data; b) the purposes and methods of processing; c) the logic applied if the processing is carried out with electronic means; d) the identification details of the Controller, the processors, and the designated representative under Art. 3(1) GDPR; e) the entities or categories of entities to whom the personal data may be communicated or who may become aware of it; iii. obtain: a) updating, rectification or integration of data; b) erasure, anonymization or blocking of data processed unlawfully, including data whose retention is unnecessary for the purposes for which they were collected; c) confirmation that actions under a) and b) have been communicated to those to whom data were disclosed, unless this is impossible or involves disproportionate effort; iv. object, in whole or in part: a) on legitimate grounds, to the processing of personal data concerning you; b) to the processing of personal data for marketing or commercial purposes, through automated systems, email, or traditional methods such as telephone or post. Where applicable, you also have the rights under Articles 16-21 GDPR (Right to rectification, right to erasure, restriction, portability, objection), and the right to lodge a complaint with the Supervisory Authority.
You may at any time obtain confirmation of whether or not personal data concerning you exist, and obtain communication of such data and the purposes on which processing is based. You may also request the erasure, anonymization or blocking of unlawfully processed data, as well as updating, rectification, or integration of data. You may object to the processing for legitimate reasons. Please promptly notify our office of any changes to your personal data to comply with the law that requires data to be accurate and updated.
